What is a fiduciary and why might I need one?

A fiduciary is a person or entity who accepts a position of trust and acts on behalf of another person or persons to manage assets. A fiduciary is legally and ethically required to act in the other’s best interest. In the state of California, a professional fiduciary is licensed through the Professional Fiduciary Board, which operates under the Department of Consumer Affairs.

You may need the services of a fiduciary to care for a family member who is unable, due to a variety of circumstances, to manage their own financial affairs or their own physical care. You may require an unbiased third party as a trustee for your estate or for a power of attorney.
